Durham county has agreed to pay the owners of a former U-Haul site $2.8 million for a site on which a new courthouse complex is proposed: http://www.newsobserver.com/145/story/796493.html.

Though the county was using its power of eminent domain to take the property, it was mandated to pay fair market value. How can eminent domain prove a challenge to owners of commercial property?
